By accessing the Website, placing an order, or otherwise transacting with us, you ("Customer", "you") confirm that you have read, understood, and agreed to be bound by these Terms.
1. About Us: PEGO Hardware is the brand of Shah Hardware Mart, a manufacturer and supplier of UPVC and aluminium window and door hardware. Our registered place of business is in Sahibabad Industrial Area, Ghaziabad, Uttar Pradesh, India. GST Registration No.: 09AABFS7087A1Z6.
2. Eligibility: By using the Website, you represent that you are at least 18 years of age and are competent to enter into a legally binding contract under the Indian Contract Act, 1872. If you are using the Website on behalf of a business entity (builder, fabricator, dealer, architect, interior designer, or similar), you additionally represent that you are duly authorised to bind that entity to these Terms.
3. Products & Information: Our catalogue includes hardware for UPVC and aluminium windows and doors including but not limited to handles, hinges, rollers, gear boxes, friction stays, locks, cylinders, multi-point locks, and slide-fold systems.We make reasonable efforts to display accurate specifications, finishes, dimensions, and images on the Website and in our catalogues. However, actual product appearance (colour, finish, surface texture) may vary slightly due to screen settings, lighting, or batch-to-batch manufacturing tolerances. Such variations shall not be treated as a defect.Technical drawings, load ratings, and installation guides are provided for reference. Final suitability for a specific application must be verified by a qualified fabricator or installer.Product designs, SKUs, pricing, and availability are subject to change without prior notice.
4. Pricing & GST: All prices listed on the Website or in our pricelists are in Indian Rupees (INR) and are exclusive of GST unless expressly stated otherwise.GST is charged at the applicable rate at the time of invoicing. The applicable rate and HSN code will appear on your tax invoice.Wholesale, bulk, project, and trade prices are quoted separately on request and may differ materially from MRP or retail prices shown.Any discounts, scheme offers, or credit terms are at PEGO's sole discretion and may be withdrawn or amended at any time.In the event of a pricing error on the Website or any invoice, PEGO reserves the right to cancel the affected order and refund any amount already paid.
5. Orders & Acceptance: Placing an order through the Website, by email, telephone, WhatsApp, or through our sales team constitutes an offer to purchase. An order is deemed accepted only when PEGO issues a written confirmation (proforma invoice, order acknowledgement, or tax invoice).PEGO reserves the right to accept, refuse, or cancel any order in whole or in part including, without limitation, where stock is unavailable, pricing is incorrect, credit checks are unsatisfactory, or the order is suspected to be fraudulent or in breach of these Terms.Minimum order quantities may apply for certain SKUs, series, or project supplies.Custom-built, made-to-order, or project-specific items are non-cancellable once production has commenced.
6. Payment Terms: Unless otherwise agreed in writing, orders are to be paid in advance by NEFT/RTGS/UPI/bank transfer against proforma invoice.Credit terms, where offered to approved trade customers, will be set out in a separate written arrangement and are subject to periodic review.Overdue invoices may attract interest at the rate of 18% per annum (or the maximum permitted by law, whichever is lower), computed from the due date until actual realisation.Title in the goods remains with PEGO until full payment has been received in cleared funds. Risk in the goods passes to the Customer on handover to the Customer, their representative, or the transporter whichever is earlier.Cheque payments are accepted subject to realisation. Dishonoured cheques will attract charges and may be referred for action under Section 138 of the Negotiable Instruments Act, 1881.
7. Delivery & Dispatch: PEGO despatches goods pan-India through its authorised transporters and courier partners. Delivery timelines quoted are indicative and not of the essence of the contract.Freight, insurance, loading, octroi, entry tax (where applicable), and other logistics charges are to the Customer's account unless agreed otherwise in writing.Delays caused by transporters, port congestion, natural events, strikes, lockdowns, or any cause beyond PEGO's reasonable control shall not entitle the Customer to cancel the order or claim damages.The Customer must inspect goods at the time of receipt and record any shortage, breakage, or visible damage on the transporter's receipt and photograph the condition before unloading. Claims not recorded at delivery cannot be entertained.Any discrepancy in quantity or packing must be reported in writing to info@pego.in within 48 hours of delivery, failing which the delivery shall be deemed accepted in full.
8. Returns, Replacement & Refunds: Standard-catalogue goods may be considered for return or replacement only if they are unused, in original packaging, and reported within 7 days of delivery with photographs and the original invoice.Custom-made, project-specific, cut-to-size, or special-finish items are strictly non-returnable and non-refundable.Approved returns will be subject to inspection. Freight for return is to the Customer's account unless the return is due to a manufacturing defect verified by PEGO.Refunds, where approved, will be processed to the original payment instrument within 7–14 working days of approval, net of any applicable deductions.
9. Warranty: PEGO products carry the manufacturer's warranty specified in the respective product documentation or on the invoice. Warranty cover is limited to replacement or repair of parts found defective in material or workmanship under normal, intended use.The warranty does not cover.
(A) Normal wear and tear.
(B) Damage from improper installation, misuse, or lack of maintenance.
(C) Damage from exposure to corrosive atmospheres, saline conditions, chlorinated or acidic cleaning agents, or marine environments unless the product is expressly rated for such use.
(D) Products that have been modified, repaired, or combined with non-PEGO components without PEGO's written approval.
(E) Cosmetic variations or minor surface marks that do not affect function.Warranty claims must be supported by the original invoice and photographs/videos of the defect. Decisions on warranty cover are at PEGO's sole discretion.In no event shall warranty liability exceed the invoice value of the affected product.
10. Installation: PEGO is a hardware supplier. Unless expressly agreed in writing, we do not undertake installation of windows, doors, or hardware at the Customer's site. The Customer is responsible for appointing qualified fabricators and installers. Any technical advice, drawings, or installation videos provided by PEGO are for reference only and do not amount to a warranty of installed performance.
11. Intellectual Property: All content on the Website including the PEGO name and logo, product designs, drawings, photographs, videos, text, catalogues, pricelists, and software is the exclusive property of Shah Hardware Mart or its licensors, and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute, publish, modify, or create derivative works from any such content without our prior written permission, save for permitted personal, non-commercial reference by bona fide customers evaluating a purchase.
12. Permitted Use of the WebsiteYou agree not to:
(A) use the Website for any unlawful, fraudulent, or abusive purpose.
(B) attempt to gain unauthorised access to any portion of the Website, our servers, or related infrastructure.
(C) use any automated means (bots, scrapers, crawlers) to extract data from the Website without our written permission.
(D) upload or transmit any virus, malware, or harmful code.

14. Third-Party Links: The Website may contain links to third-party websites or resources (such as logistics partners, payment gateways, or trade associations). PEGO is not responsible for the content, availability, policies, or practices of such third-party sites and does not endorse them.
15. Limitation of Liability: To the maximum extent permitted by law, PEGO's aggregate liability arising out of or in connection with any order or use of the Website shall not exceed the invoice value of the goods giving rise to the claim.PEGO shall not be liable for any indirect, incidental, consequential, special, or punitive loss including loss of profits, loss of business, loss of contracts, project delays, site damages, labour or scaffolding costs however arising.Nothing in these Terms excludes or limits liability which cannot be excluded under applicable law.
16. Force Majeure: PEGO shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including (without limitation) acts of God, floods, fire, earthquake, epidemic or pandemic, war, civil unrest, terrorism, government action, strikes, lockouts, raw-material shortages, failure of utilities, transporter strikes, or disruption of ports or logistics corridors.
17. Confidentiality: Pricing, discount schedules, trade terms, project quotations, drawings, and any other commercial information shared by PEGO with the Customer are confidential and shall not be disclosed to any third party or used for any purpose other than the specific transaction without PEGO's prior written consent.
18. Privacy: Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Website, you consent to our processing of your information in accordance with that policy.
19. Changes to the Terms: PEGO may update or amend these Terms from time to time by posting the revised version on the Website. The "Last updated" date at the top will indicate when changes were made. Continued use of the Website or placing of further orders after any change constitutes acceptance of the revised Terms.
20. Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, the courts at Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
21. Dispute Resolution: Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably by the parties. Failing amicable resolution within 30 days, the dispute shall be referred to arbitration by a sole arbitrator to be appointed by PEGO, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Ghaziabad, and the language shall be English.
22. Severability & WaiverIf: Any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Any failure or delay by PEGO in enforcing any right under these Terms shall not operate as a waiver of such right.
23. Entire Agreement: These Terms, together with any proforma invoice, tax invoice, written quotation, or specific written trade arrangement between the parties, constitute the entire agreement between you and PEGO in respect of the subject matter hereof and supersede all prior discussions, representations, and communications.
